The Mountaineers had sought to get out of the Big East without waiting 27 months, as stated within the league's rules. The Big East countered, seeking to hold West Virginia to the waiting period.
"West Virginia University has acknowledged and agreed that the Court in Monongalia County, West Virginia, will enter a judgment that the Big East Conference bylaws are valid and enforceable, and will dismiss with prejudice all of West Virginia's claims against the Conference," Big East commissioner John Marinatto said in a statement.
The Big East said the payment of the exit fee was "well in excess of that required by the bylaws." Previous reports put that amount in the range of $20 million.
"This closes a chapter and opens a new one filled with exciting possibilities for WVU's future," West Virginia athletic director Oliver Luck said in a news release. "I've heard from Mountaineer fans across the country who have made it very clear that they are proud and honored to be heading into the Big 12."
Syracuse and Pitt are also leaving the Big East and heading to the ACC, though both are willing to wait the 27 months. Despite the impending losses, the Big East has added seven members and will be at 12 teams by the 2015 season.

McCarney, 58, told the paper he suffered a stroke after working out Sunday and was rushed to a hospital via helicopter.
"I was just sitting down to eat a sandwich when my left side went numb," McCarney told the Register. "Talk about a scary feeling. Something happened on the left side in the back of my brain. My left side -- all of a sudden everything went numb."
McCarney, who also coached at Iowa State from 1995-2006, is undergoing tests. He said doctors expect a full recovery and no permanent damage.
"I've got too much Irish in me to stay down very long," McCarney told the Register. "... I feel good right now. I've got a little tingling feeling, but hey, if that's the worst of it, I'd say I'm a pretty lucky guy. Nothing wrong with me that a little Grey Goose won't cure."
