Former Rutgers QB Hart's lawsuit vs. EA Sports gets boost

The legal battle over player likeness just got a jolt to the lineup.

Former Rutgers quarterback Ryan Hart has added noted attorney Arthur Miller to his legal team in a lawsuit seeking compensation for the use of his likeness in the EA Sports college football video game. Miller, a professor at New York University, has been called a leading scholar in civil procedure.

Hart's is one of three "likeness" lawsuits filed against EA, the most notable of which is the Ed O'Bannon action.

Miller, who will turn 80 next year, has argued cases in every US Circuit Court of Appeals and many before the Supreme Court. For two decades he appeared as a legal expert on ABC's Good Morning America. Miller also won an Emmy for his work explaining the Constitution on PBS.

Miller joins a strengthened legal lineup for Hart that now includes the powerful Lanier Law Firm. Founder Mark Lanier has been called "one of the top civil trial lawyers in America" by the New York Times.

Sports law attorney Eugene Egdorf also has been added from Lanier. Egdorf's handing of a wrongful death lawsuit led to the NCAA recommending testing for sickle cell trait.

The attorneys join Tim McIlwain, who filed Hart's original suit in 2009. In May, a US Circuit Court of Appeals found that EA had violated Hart's right to control his image. That reversed an earlier dismissal of the suit.

Last week former Arizona State and Nebraska quarterback Sam Keller won an appeals court ruling against EA.
