Monta Ellis, Warriors sued for sexual harassment

An explosive lawsuit involving indecent text messages has been filed against an NBA star.

The Contra Costa Times reports
that a former Golden State Warriors employee has sued the team and guard Monta Ellis for sexual harrassment. The lawsuit also alleges that the Warriors terminated her employment in an effort to cover up the scandal.
According to an email from the Law Offices of Burton F. Boltuch, the plaintiff will file the suit Wednesday morning in Oakland at the Superior Court of Alameda County. Afterward, a press conference will be held to discuss the allegations.

According to Boltuch, the plaintiff is accusing Ellis of sexually harassing her from November 2010 to January 2011. The accuser, according to Boltuch, has photo evidence of the harrassment, which he claims was sent from Ellis’ cell phone to the plaintiff.

The photo will be revealed – along with the identity of the accuser – at the press conference, Boltuch said.

“You will be shocked when you see it,” Boltuch said. “It’s pretty disgusting and graphic.”
The San Francisco Chronicle reports that Ellis sent "dozens" of text messages, including one of a "graphic photo of [his] genitalia."
Erika Ross Smith said in a lawsuit filed in Alameda County Superior Court Tuesday that Ellis began sending her explicit messages in November 2010 while she worked in the team's community relations department.

Ellis allegedly texted Smith "several times in a single day, late at night or in the early morning hours," using a "secret" telephone with a 601-area code, the suit claims. The texts from Ellis included phrases like "I want to be with you," and "Hey Sexy," to which Smith responded with "What do you want?" and "I am sleeping," the suit alleges.

Smith's attorney, Burton Boltuch, said his client's job description was abruptly changed after Ellis' wife, Juanika Amos Ellis, learned of the texts in January and complained to team executives. 
The San Jose Mercury-News reports that Warriors president Rick Welts issued a statement on Wednesday, insinuating that this lawsuit was a money grab and fighting back against the claim that the organization had professionally punished the plaintiff because of the relationship.
When we were made aware of a consensual relationship between Mr. Ellis and the Plaintiff, we did what an organization should do. We told both to stop – promptly, directly and fairly. The Warriors have never taken any action against the Plaintiff for any inappropriate reason, and we deny the allegations she is making.

We live in a litigious society in which lawsuits too frequently are driven by money and not the pursuit of justice. We will vigorously defend the reputation of the Warriors organization in the courts. We don’t plan to make any further comment about the details of the case.”
Ellis, 26, is married and has one son. 

He averaged a team-high 24.1 points per game for the Warriors last season.

Wow, the trolls are out full force today, LoL......

I think we have to know more about the case before deciding either way.  These cases (and sexual assault cases) are tough because there ARE a lot of unscrupulous women out there trying to make money off the players and celebrities.......but we can't just disregard every one, because there ARE some legitimate claims where a woman was wronged or worse.  We have to look at the evidence and decide, and there hasn't been any evidence released yet.  For example, personally I thought, once I looked at the evidence, that Kobe was innocent, Roethlisberger was guilty, Duke Lacross was innocent and a complete abuse of power........etc etc.

People are so quick to jump to conclusions and crucify one party or another in cases like these, as well as in criminal cases which is even worse, since the accused in criminal cases are supposed to be innocent until proven guilty.  While civil cases don't have this expectation, it still disgusts me to see some of the responses before all the facts are even in......even if most are trolls........

My first question would be, if this was so unwanted, how did he get her cellphone number in the first place?  Also, why not block him and be done with it? 

Of course this could be true, but on the flip side, she could be looking for some money.  In the end, I will probably never ever worry about this for the rest of my life, so really, I don't care.

I think the woman should be grateful to have someone like Monte interested in her. Why is she complaining? Because Monte wouldn't pay for plasic surgery? But, then again if Monte really sent dick pics then he is a moron...and the NBA needs to force KIDS to enter college and play all four years.  Maturity is important and black players have none. Yes, the Whites are better behaved because they were raised better. And most likey had both parents.

I would be suprised if Monte can even read....Have you ever heard give an interview? He can't speak...he's just a stupid person with ball skills.

Hey Ftballgenious.......you need to change your name, genious should in no way be associated with you.  So it is only white women trying to get one over on the brotha's that would make such an accusation?  Is this the white folk trying to keep the black man down because he earned a few bucks?  Sexual harrassment goes on every day, it is perpetrated by both men and women; it is very subjective in how it is defined as each individual has their own threshold of what is okay and what is not.  Based on your ignorant post I am sure you harrass people everyday and think nothing of it.
Why don't we wait until the facts come out before we crucify either party.......oh wait, that would make sense, we should make horrible assumptions instead.  A photo is not harrassment?  Take a picture of your junk and show it to the women in your place of work (assuming you actually work and are not living on my tax dollars) and see how long it takes before you are fired and sued.
