WAC to file suit against Fresno St., Nevada, MWC

The WAC already knew they would be losing the Boise State Broncos to the Mountain West Conference, but they were caught off guard to hear before the season that Fresno State and Nevada had also made plans to make the same move.  The conference, which will be left severely crippled with the exit of three teams, has decided to take legal action against the departing universities.  

The Reno Gazette-Journal reported Tuesday that the WAC will file a lawsuit against Fresno State, Nevada, and the Mountain West Conference.  
The lawsuit, through the Golden, Colo., office of Bradley, Devitt, Haas & Watkins, claims more than 20 allegations. It was filed in District Court in Jefferson County, Colorado.

A message left with attorney Jon Bradley was not immediately returned.  

The WAC is seeking that Nevada and Fresno State not withdraw from the conference before June 30, 2012, that all defendants (including the Mountain West) be prohibited from scheduling contests that interfere with games to be played against remaining WAC members through 2011-12, and for further relief as the court sees just.

The Gazette-Journal contacted a representative from Nevada who confirmed that the university had received the lawsuit and indicated that they were "disappointed" that the suit was filed before any discussions had taken place.  Nevada and Fresno State accepted the Mountain West Conference's invitation to join the conference on August 13.

One of the fire-starters in this in western realignment was BYU's move to football independence, which will occur officially on June 30, 2011.  When the rumors of BYU's independence began, the Mountain West Conference was quick to act to try and replace them.  The WAC was hoping to at least get BYU's other sports, but the Cougars decided to take a majority of those teams (including basketball) to the West Coast Conference.

WOW, we have a TON of lawyers in here!  Someone even knows secret conversations. 

We shall see, I hate this whole process , schools work hard to get in a conference and poof, some leave screwing the remaining schools. 

Blame the BCS partly.  This process has made a joke out of the national championship.  What are schools like Boise and Utah supposed to do?  You win everying and the BCS aka Mafia says, not good enough. 

It is all crap and unAmerican.

What I can't get over, and someone already mentioned it, is how hypocritical this Benson guy is.  He was ok with stealing BYU away behind everyone's back, but he's going to sue because Nevada and Fresno want out of this lame conference?  I hope this lawsuit gets thrown out.

The WAC created its own downfall years ago when they created the 16 team super conference. Then most of the original WAC teams broke away and became the Mountain West. Then came the BCS, and let's face it, Big East, ACC, Mountain West, WAC, Independents, C-USA, MAAC, & Sun Belt teams aren't invited. They can play in those other meaningless Bowl games. Then Boise St., a WAC team, beat Oklahoma, then the conferences broke up again, with Boise St. leaving the WAC. Now Fresno St. & Nevada want an opportunity to be in a BCS-buster conference; and the WAC ain't it.

I get the Girlfriend comment but if you have an employee that leaves he's most likely signed a noncompete. This would allow you to go after the employee for rendering his services in an area that directly ties to the work you perform. I think that these schools either signed or verbally agreed to this contract. I'm not sure the extent of the contract but I do know that the 5 mil is a large part. There might be other factors but I think the WAC is simply trying to make sure it's upheld. The part about the MWC is a little vague and I wonder what language they'll use to justify the suit. Very interesting and very sticky.

Well said Baloo. 

If you have an employee that's unhappy and wants to go somewhere else what do you do?  Do you force them to stay?  They'll be unhappy and unproductive.  What if your girlfriend is tired of you and wants to move on?  Are you going to force her to stay?  she'll be miserable and make your life miserable.  The WAC just lost three girlfriends and they want to punish them for leaving.  Let them go.  Get over it.  Find another girlfriend.  Yeah, the new one won't be as pretty is the one that howled like a wolf, but, who knows what she might do for you.

What I'd like to know is what is the WAC going to do with $10 million dollars?  Will they split that up between the remaining schools?  Stow it away for a rainy day?  After paying legal fees, that $10 million will most likely dwindle down to $5-$7 million.

Huh? You say send the eastern schools packing, but the only one is LaTech and you suggest replacing it with North Texas... which isn't that far from LaTech? And then you say to get San Diego State back because of travel issues... and then say they have to travel to Hawaii and either LaTech or North Texas... bad planning on your part.

I can't believe the California State University system is not stepping in against this lawsuit.  They are on both sides and I assume each school would have to spend money in this matter.  I think if this lawsuit continues it will also be the down fall of San Jose St.  The Cal State system is barely able to support three programs.  Will Benson sue San Jose St. for dissolving?? 

I have also seen the reports that this contract would not be valid if BYU didn't not join the WAC by a certain date.  But it sounds like this suit is about departure date.

WAC is done and Benson's gravy train job is done too!

Agreed. This is a "face saving, we're doing something move." No merits to the suit and won't go anywhere. The new deal was not signed and even if it was, the WAC has not even lived up to it portion, bringing in BYU.

The best move for the WAC would be to try to regroup. See if they can get SDSU who is getting killed by travel costs. Send their eastern schools packing, try to get North Texas and work to keep Hawaii who is thinking about going Independent. I think there's a moratorium on FCS schools moving up so they're in a bit of pickle getting schools that way.
