WAC to file suit against Fresno St., Nevada, MWC

The WAC already knew they would be losing the Boise State Broncos to the Mountain West Conference, but they were caught off guard to hear before the season that Fresno State and Nevada had also made plans to make the same move.  The conference, which will be left severely crippled with the exit of three teams, has decided to take legal action against the departing universities.  

The Reno Gazette-Journal reported Tuesday that the WAC will file a lawsuit against Fresno State, Nevada, and the Mountain West Conference.  
The lawsuit, through the Golden, Colo., office of Bradley, Devitt, Haas & Watkins, claims more than 20 allegations. It was filed in District Court in Jefferson County, Colorado.

A message left with attorney Jon Bradley was not immediately returned.  

The WAC is seeking that Nevada and Fresno State not withdraw from the conference before June 30, 2012, that all defendants (including the Mountain West) be prohibited from scheduling contests that interfere with games to be played against remaining WAC members through 2011-12, and for further relief as the court sees just.

The Gazette-Journal contacted a representative from Nevada who confirmed that the university had received the lawsuit and indicated that they were "disappointed" that the suit was filed before any discussions had taken place.  Nevada and Fresno State accepted the Mountain West Conference's invitation to join the conference on August 13.

One of the fire-starters in this in western realignment was BYU's move to football independence, which will occur officially on June 30, 2011.  When the rumors of BYU's independence began, the Mountain West Conference was quick to act to try and replace them.  The WAC was hoping to at least get BYU's other sports, but the Cougars decided to take a majority of those teams (including basketball) to the West Coast Conference.

there is no way this suit holds up. nevada and fresno presidents weren't going to be bound by an agreement in the event BYU didn't go into the conference.

What a freakin' joke!

The WAC was secretly talking to BYU about having them join the WAC in all sports except football.  When that was discovered and the MWC jumped to snag the other 2 schools the WAC got their panties in a bunch.  Guess it is ok for them to try to steal a school but if someone else does it they want to waste university money on a stupid lawsuit.

The WAC is dead.  It died when half of its members decided to form the Mountain West some years ago. The reality is the the BCS and its conferences control the money and money bowls, the BCS conferences are all going to 12 teams, if you want into the BCS later, you  need 12 teams, finally there aren't enough schools in the west to form more than 2 BCS level conferences.  
The Pac12 is full, the MWC is having trouble getting there, and the WAC won't, there's no one left.  I'm not wild about it either, but there it is.

From what I read, the WAC buyout contract plainly said it was not enforceable unless BYU joined by a certain date.  The WAC lawsuit is a 97% loser, with 3% error for a crazy jury.  Most likely the WAC loses on Summary Judgment and it doesn't even make it to trial.

the WAC Commisioner is just trying to save face.

I believe it's because prior to Boise leaving, there wasn't anything in the WACs bylaws that posed any penalties for schools leaving.  After Boise left, the WAC had the remaining schools agree to commitment, along with a strong buyout clause. 

What Nevada is arguing is the school never signed the new agreement, however, the WAC is saying they did not submit their intentions prior to a supposed deadline thus making the new contract effective by default.

Either way it's ugly and unfortunate.  Hopefully all this conference alignment stuff will stop, but I don't think it's going to anytime soon.

Why just these teams? Why not include Boise State in the lawsuit?

The WAC doesn't appear to be going down without a fight!  Had they not got into bed with BYU in the first place, this wouldn't be an issue.  Who's gonna sue BYU?
