On Sunday the Denver Broncos, and Tim Tebow in particular, were blowing the minds of football fans across the country while beating the Pittsburgh Steelers in the first round of the NFL playoffs. It was pretty much a wonderful day to be a Broncos fan, but it was also a day that may find the team in court soon.

That's because after the Broncos beat the Steelers in overtime there was this tweet from Texas A&M's Vice President of Marketing and Communications, Jason Cook.



Yes, before the game a man parachuted into the stadium waving a flag that said "12th man" and the flag was waved during the game. Which seems completely harmless and pretty much commonplace, but Texas A&M owns the trademark for it and is planning on getting its money.

It's not the first time that the school has gotten involved in something like this, as it filed a lawsuit against the Seattle Seahawks in 2006 for the same thing. Now any Seahawks broadcasts that mention the crowd as "the 12th man" also has to mention Texas A&M's trademark.

Seems pretty stupid, right? Yeah, that's because it is, though there's also an easy solution. Instead of referring to your home crowd as "the 12th man" just start referring to them as "the 12th player." Then Texas A&M will have to find a whole new way to waste everybody's time.

Tx A&M has a tradition of mediocre football... They should worry about how they are going to stay out of the bottom of the SEC first...

A&M has every right to protect their trademark (that they paid for).
You can trademark a phrase online for $275 at uspto.gov. Big deal.

I wonder if anyone in the Broncos organization has thought of making those little rubber bracelets with WWTD on them?  That's something they could trademark.

I'm going to trademark the word "The" and everytime anyone uses it without my permission I'm going to sue. What a joke being able to trademark words. I'm also going to put in a property claim on the "sun" and start charging everyone heating and lighting bills. I'll be a $$trazillionare. Jason Cook should worry more about player's GPA's then this nosense.

A&M has every right to protect their trademark (that they paid for).  With that said, trademark laws are instituted to protect others from profitting off of a name or brand.  I think a simple phone call to the Denver Broncos might have been sufficient instead of having it blow up on Twitter.  They could have made sure that the Bronco organization did not intend on profitting from the events that took place this weekend regarding the "12th man" referral.  Now A&M look like fools or grinches when in fact, they are just trying to protect their trademark.  I am sure it could have been done in private to avoid the negative publicity that A&M seems to be receiving from pretty much everyone outside of "Aggie Nation".....wonder if they have that saying TM'd as well??!

Awkward day for Von Miller and Ty Warren of the Broncos. Both A&M alums.  While I think trademarking words is just ridiculous anyway, it is a law.  Anyone associated with football should have some familiarity with A&M's "The 12th Man".  Kinda lazy to not follow through and get their permission to use it. 

"Then Texas A&M will have to find a whole new way to waste everybody's time" might be one of the worst lines of journalism written.  Funny thing to write about a team moving to the conference that has a contractual obligation with your employer. Guess that was Fornelli's attempt at edgy.

Unless I'm missing some other intent in your post, you would be completely wrong.  The Seattle Seahawks have already acknowledged as much.
