On Sunday the Denver Broncos, and Tim Tebow in particular, were blowing the minds of football fans across the country while beating the Pittsburgh Steelers in the first round of the NFL playoffs. It was pretty much a wonderful day to be a Broncos fan, but it was also a day that may find the team in court soon.

That's because after the Broncos beat the Steelers in overtime there was this tweet from Texas A&M's Vice President of Marketing and Communications, Jason Cook.

Yes, before the game a man parachuted into the stadium waving a flag that said "12th man" and the flag was waved during the game. Which seems completely harmless and pretty much commonplace, but Texas A&M owns the trademark for it and is planning on getting its money.

It's not the first time that the school has gotten involved in something like this, as it filed a lawsuit against the Seattle Seahawks in 2006 for the same thing. Now any Seahawks broadcasts that mention the crowd as "the 12th man" also has to mention Texas A&M's trademark.

Seems pretty stupid, right? Yeah, that's because it is, though there's also an easy solution. Instead of referring to your home crowd as "the 12th man" just start referring to them as "the 12th player." Then Texas A&M will have to find a whole new way to waste everybody's time.

Texas A&M going after the Denver Broncos

While visiting in college station in the late 90's, I met some students who proudly told me when they receive their senior rings they go to the local chicken and beer dive, drop the ring into a pitcher of beer, and can't wear the ring unless they can chug the beer in less seconds than their graduation year.  In other words, they had a minute and a half to down the pitcher and then put on their aggie ring.  Sure they said, some kids puke it all up but that is the beauty of being an Aggie.  The 25 or so campus ministry coalition pastors asked the school to speak out against this but the Aggie faithful said to me, "It's a tradition."  Tradition is everything to the Ags.  If students die building the bonfire, which any Aggie knows is only called bonfire, no "the" preceding it, tradition you remember, then these brilliant engineering zealots build it on private property.  Back to the pitcher downing seniors, I said that was fine and good here in the 90's, my 80 year old Sunday school teacher can down a pitcher in under 99 seconds, but what about the classes of '00 to '15 or so, what do you do then?  They just stared in disbelief, not having looked beyond the tradition they were fighting for.  As it turns out, by the turn of the century, the math whizzes at A&M got together and publicly stated, "The chugging of a pitcher of beer to wear your senior ring is not really a tradition and the practice should cease."  So The 12th Man...well they invented it.  That's cool.  One thing they didn't invent was football and they sucked in the Big 12 and tradition points to them sucking even more in the SEC.

Try using an NFL trademark and see how fast they have their lawyers contacting you and dragging your butt into court. Why do you think it's a waste of time or it makes A&M look foolish.

Texas A&M has every right to do it.  That is why you have trademarks.  What is more stupid than that is saying that the NFL has the rights to "Who Dat?"     C'mon Man...
