On Sunday the Denver Broncos, and Tim Tebow in particular, were blowing the minds of football fans across the country while beating the Pittsburgh Steelers in the first round of the NFL playoffs. It was pretty much a wonderful day to be a Broncos fan, but it was also a day that may find the team in court soon.

That's because after the Broncos beat the Steelers in overtime there was this tweet from Texas A&M's Vice President of Marketing and Communications, Jason Cook.



Yes, before the game a man parachuted into the stadium waving a flag that said "12th man" and the flag was waved during the game. Which seems completely harmless and pretty much commonplace, but Texas A&M owns the trademark for it and is planning on getting its money.

It's not the first time that the school has gotten involved in something like this, as it filed a lawsuit against the Seattle Seahawks in 2006 for the same thing. Now any Seahawks broadcasts that mention the crowd as "the 12th man" also has to mention Texas A&M's trademark.

Seems pretty stupid, right? Yeah, that's because it is, though there's also an easy solution. Instead of referring to your home crowd as "the 12th man" just start referring to them as "the 12th player." Then Texas A&M will have to find a whole new way to waste everybody's time.

Interesting.  I was pretty much indifferent toward Texas A&M before...but now I actually have a reason to not like them.  If Denver starts trying to sell 12th Man gear, then yeah, quietly file suit....but for simply referring to the fans as the 12th man (really, every team doesn't do that?)...and tweeting about it?  Come on.  I guess that's what you expect from a program that doesn't actually compete for conference or national titles...to stake it's claim to something irrelevant and treat it as though it matters.  Reeks of inferiority.

LMAO this too funny!!!!  A&M Sues the Seahawks, A&M wants to sue the Broncos...and then they wonder why Longhorn fans laugh at their cries of "unfair" about the Longhorn network.  A&M Blames UT and the Big12 so they run off to the SEC......it's always someone is doing me wrong coming out of College Station.not sure how being the 12th man on such a mediocre team is working out...but good luck with it anyway....HOOK 'EM!!!!

I'm surprised they didn't know that, as relevant as A&M football is...  Maybe A&M should also trademark "underachieving" and "sucking".  Then people might be more familiar with the association.

Brass Rat: Although TAMU may not have "filed a trademark" on the 12th man thing until 1990, I am glad you recognize that it had been their thing since 1922.  Legally, perhaps, the Seahawks may have had a right to use it (I am not sure, since common law often trumps written law), you'd have to admit that the thing belongs to TAMU based on their long history with it.  Why else would the Seahawks have settled?  I really hate it when people use legal technicalities to defend wrong behavior, when everyone with half a brain know who is in the right.
