On Sunday the Denver Broncos, and Tim Tebow in particular, were blowing the minds of football fans across the country while beating the Pittsburgh Steelers in the first round of the NFL playoffs. It was pretty much a wonderful day to be a Broncos fan, but it was also a day that may find the team in court soon.

That's because after the Broncos beat the Steelers in overtime there was this tweet from Texas A&M's Vice President of Marketing and Communications, Jason Cook.



Yes, before the game a man parachuted into the stadium waving a flag that said "12th man" and the flag was waved during the game. Which seems completely harmless and pretty much commonplace, but Texas A&M owns the trademark for it and is planning on getting its money.

It's not the first time that the school has gotten involved in something like this, as it filed a lawsuit against the Seattle Seahawks in 2006 for the same thing. Now any Seahawks broadcasts that mention the crowd as "the 12th man" also has to mention Texas A&M's trademark.

Seems pretty stupid, right? Yeah, that's because it is, though there's also an easy solution. Instead of referring to your home crowd as "the 12th man" just start referring to them as "the 12th player." Then Texas A&M will have to find a whole new way to waste everybody's time.

I thought they played in different leagues.

Since they couldn't win in the Big 12 now they think they can beat the Denver Broncos.

What the SEC wasn't tough enough for you?

Since they are the Broncos, why not call them the 12th horse, or hoss or steed or some other horse word. Why use man at all?

A little ironic since Gary Kubiak was both an A&M QB and long-time Denver Bronco. I've herd that term so many times before but never of a pointless lawsuit.  How embarassing for A$M.... :)

This is just like some one trying to trade mark fans or fanatics the 12th man has been used by announcers across this fine country for many years. They talk about the home field advantage as the 12th man in high school, Collage and the pro's. So get over it Texas A&M, terrible towels horrible hankies. 10 th man in baseball what else is this greed going to ruin.

His bosses has sued to protect their trademarks. OK, for CBS but not A&M to do it? OK for CBS to waste people's time by suing to protect theirs, but not A&M. Jason is hypocritical!!!!

Does no one understand trademark laws? When you have a trademark you are required to defend it by law or you lose it. Maybe everyone should be able to take anything from everyone I guess. You are all ignorant tools! Again, required by law to defend it. Don't sue and you lose your rights to it. Derrr

I thought the tradition was to have a walk on wear the #12 and play on special teams. I would think that plucking someone from the stands to actually play has to be against all the rules of college football.
That is how the tradition is currently applied; a walk-on wears #12.  However, the tradition began with a person coming from the stands to dress during the Dixie Bowl (later called Cotton Bowl).  The man's name was E. King Gill, and his statue stands outside Kyle Field to this day.
