On Sunday the Denver Broncos, and Tim Tebow in particular, were blowing the minds of football fans across the country while beating the Pittsburgh Steelers in the first round of the NFL playoffs. It was pretty much a wonderful day to be a Broncos fan, but it was also a day that may find the team in court soon.

That's because after the Broncos beat the Steelers in overtime there was this tweet from Texas A&M's Vice President of Marketing and Communications, Jason Cook.



Yes, before the game a man parachuted into the stadium waving a flag that said "12th man" and the flag was waved during the game. Which seems completely harmless and pretty much commonplace, but Texas A&M owns the trademark for it and is planning on getting its money.

It's not the first time that the school has gotten involved in something like this, as it filed a lawsuit against the Seattle Seahawks in 2006 for the same thing. Now any Seahawks broadcasts that mention the crowd as "the 12th man" also has to mention Texas A&M's trademark.

Seems pretty stupid, right? Yeah, that's because it is, though there's also an easy solution. Instead of referring to your home crowd as "the 12th man" just start referring to them as "the 12th player." Then Texas A&M will have to find a whole new way to waste everybody's time.

What?  You sir are a total moron. 

When I got done reading the article the first thing that occrred to me, is, what a waste of time.  At first I thought it was a joke. 


Beaver, first of all, love the avatar.  Not sure if you thought I was defending A&M with my comment, but I wasn't. It was merely a statement towards lazy opinionated writing. I'd like to think that we're all very capable of determining what we consider to be a waste of our time. I waste a lot of time reading some of these articles and posts, but I don't need some ass-hat journalist telling me.  Yeah, I know, my post just wasted your time !  I'll save you the response

Doesn't Texas A&M embarrass themselves enough for their lack of being relevant most years in most sports?  But no, they have to go threatening to sue the Broncos!  What a joke.  Look, it's cute you guys call your fans the "12th man" and all that but suing just shows you are petty and immature and as a college of higher learning it's pretty pathetic.

So the VP of Marketing for A&M wants to so over the 12th man, good for him.  What gets me is that the VP of Marketing for any company takes to Twitter to announce their intentions.  Social media is big, but way to cross the line, Dan Gilbert.

Well Texas A & M at least has something, they haven't exactly done much on the field of play woth the 11 they have out there.   I wonder how something like that could be copyrighted?  Kind of like "Xeroxing"...even though it refers to the brand it means also means the act of maknig  a photocopy.  Xerox Corporation got all bent out of shape when this became a verb in the dictionary but they lost their appeal.  While A & M has held this copyright since 1922, until I read this article I had no idea it was copyrighted - the evidence that this phrase has entered the lexicon of American English.  Now if they want to call the grass on their field the "frozen tundra" they're welcome to it.  Wouuldn't make much snese though.  On the other hand any fan base could be referred to as the 12th man because what makes A&M fans so special?  The fact that someone decided to copyright this phrase and that someone else was silly enough to issue a copyright for it.  there comes a limit or else we a==will all need to be careful what we say.  

It is kinda like the crazy debate as to the phrase "America's Team".  It is a reference to the Cowboys and any other team trying to claim it is just being foolish.  It belongs to Dallas and they don't need to copyright it -although it would help if they would become relevant again!

Now who owns the copyright for the 19th hole, the 6th man, and the fifth quarter?  And as long as we are being silly here what about the fourth period (hockey) the 10th man (baseball) and the third half (college basketball)?
