Accused tree-poisoner Harvey Updyke has rejected a plea deal that would have sent him to prison for 13 years and -- maybe more importantly where Updyke is concerned -- prohibited him from ever attending another Alabama sporting event. 

ESPN's Mark Schlabach reported Friday that Updyke declined the plea deal "earlier this month." Updyke is scheduled to go to trial for poisoning Auburn's beloved Toomer's Corner oak trees in the Lee County (Ala.) Circuit Court March 5, but current Updyke attorney Everett Wess has requested a delay in the trial, a change of venue, and a recusal from the presiding judge.

Wess is asking that the trial be moved out of Auburn and that judge Jacob Walker III step down over his participation in an Auburn season ticket pool.

Updyke was indicted last May on two felony counts of criminal mischief, two misdemeanor counts of desecrating a venerable object and two more felony counts of an Alabama law that prohibits vandalizing or stealing any property on or from an animal or crop facility. Updyke could face as much as 42 years in prison if convicted on all counts.

Though Updyke has maintained his innocence, he has also admitted to being "Al from Dadeville," the Paul Finebaum radio show caller who boasted he had poisoned the oaks in late December 2010. Updyke has since called into the show multiple times to apologize for his actions, leading to a break with his fourth attorney, Glennon Threatt. 

The oaks are not expected to survive, forcing Auburn to search for options to keep the traditional rolling of Toomer's Corner intact. The most likely approach, as recommended this week by the Committee to Determine the Future of Rolling Toomer’s Corner, will be for the oaks to be replaced by similar-sized trees once the chosen saplings have grown large enough, and for a temporary object or objects -- like some kind of wire structure -- to be used as a temporary solution until the trees are ready.

The act of killing, or attempting to kill, the Toomer oaks is one of the most hateful and malicious acts that I had ever heard of until I considered all of the things going on in sports that are much worse.  All that I had to do was look at the daily top stories on this site.

Roethlisberger alleged rape ends in payoff.
Syracuse pedophile.
Penn State pedophile.

Crimes against humans are now common in the sports pages.  What a terrible shame.

This clown is obviously a nut job.  Yeah, you really showed everybody what a great fan you are, you poisoned the trees that students wrap in toilet paper.

I have a favorite team in my state and I am an ardent fan.  However, I am proud of the rival teams in my state as well because their success reflects well upon my home state.  I'm not going to tell this to my friends, but when a team brings attention and pride to your state there is no reason to not be proud.

How could any fan ever be proud of a Harvey Updyke and his pathetic gesture?

While initially I thought it would have been some stupid kid making a dumb mistake and now I see it's actually a stupid, pathetic middle-aged man, this story is still ridiculous all around.  Thanks to PETA and environmental nuts it is now worse to kill a tree than a person.  Lumber company owners should be sentenced to life without parole.

This stupid DA should be chained to a fence at the home opener @ Jordan-Hare w/ the cops no where in site.

13 years is too easy for him & he will be under constant police protection the entire time just like he is now.  Justice could be had in 1 day.  I would proudly wait in line for my turn to B-slap this SOB.

This is AMAZING ....... the guy must be broke by now with all the lawyers he's had already AND they best plea bargain he could get is THIRDTEEN YEARS in Jail ???  You've got to be kidding me. He's sorry he did it ...  fine. Let him pay to have more planted or transplanted there or something ...... Go after some real criminals. This is just outrageous. Maybe sentence him to life living with himself. That cant be a good thing. Jeez.

Leave it to our legal system to turn Updyke into a sympathetic figure.  The dude obviously needs to do time, but `13 years?  In my workings with various courts over the years I have dealt with several people who killed others in DUI cases or straight up manslaughter and not a one of 'em did 13 years.  Looks like this dillweed's biggest act of stupidity was commiting a "famous" crime.  Either that or he should have been a good looking, young party girl.

Killing a Tree!

This man is going to wind up going to jail for years while doing something dumb like Killing a tree. But people can Kill their babies for free? Ridiculous.

Even if he is guilty it isn't worth 13 years in prison. The way this is set up there is going to be a mis-trial with the Judge being partial to Auburn.

I'm neutral, not an Auburn or Alabama fan, I'm from nowhere near the south, and I feel this guy deserves to go away for a long time.  This was pre-meditated & destruction of historic private property.  It's the INTENT people.  He not only did this, he then brags about it on a local radio show.  This guy is an outright idiot & deserves to be put away.  I hope the 13-year plea bargain he rejects backfires & he ends up getting more time!  He knew exactly what he was doing & now he should pay the price.  There was NO EXCUSE for what he did...NONE.  This is a school rivalry...not life & death.  I know these goofballs think it is, & for the ones who think it is & end up doing something like this, they should pay dearly for it.  WAKE UP AMERICA!
