Declan Sullivan death could cost ND millions

Forbes.com is reporting that Declan Sullivan's death could cost Notre Dame at least $30 million.

The site researched Indiana liability law as well as typical wrongful death cases. That's assuming Sullivan's family sues the school.

It's not a question of ND being able to afford the cost and result of such a case. Notre Dame historically is interested in protecting its "brand". A protracted legal case doesn't do anyone any good. If that means settling with the Sullivans then that might be what it takes.

Here's my take from Sunday.

Declan Sullivan death could cost ND millions

CFR 29.1926  general duty clause.........a work site free of all recognizable hazard...  Federal law, not just a suggestion. also we will find that there was no daily inspection on the piece of equipment, and on and on.. bottom line the right thing to do is the only thing to do. the coach resigns, and possibly the AD.. The NCAA will not make ND forfeit the rest of their games, but they may take a future bowl ops away.  Do the right thing, the image of ND, and football in general is one thing but the right thing is the only thing to do. Offer a generous settlement, provide a schlorship for photo jounalism in memeory the Sullivan name and the coach has got to go... today!!!!

Declan Sullivan death could cost ND millions

I understand everyone talking about suing ND because that is where all the money is... but if that was my child, I would sue Kelly personally, not the school.  Any suits against the school would be simple gold digging...no pun intended.  The head coach is at fault for forcing a student into a dangerous situation, not the school.  Kelly can be held personally accountable for his actions without the financial loss to the students and/or athletes of Notre Dame.

whitey: You should be ashamed of yourself making a joke about something like this.  One can only hope that you someday experience the loss of a child, and then you might understand, and regret your horrible comment.  That would be karma.

Declan Sullivan death could cost ND millions

I feel badly that a young man lost his life doing his job, and yes, he shares some of the blame.  People are usually very relectant to trample on the memory of someone who just lost their life.  Beyond that, I don't think it is wrong to be talking about the legal or monetary side of this story.  That's the way our system works.

Everyone who is jumping on Dodd for bringing this up may be missing the point that it was Forbes.com that originally did the research and evidently produced the forecast of $ 30MM.

It's a tragic sports related story but people also need to know how this part of the story ends.  People want to know about "punishment" or outcomes when something really bad happens.  Why do we argue so much about how much time someone gets for a "wrongful death by athlete"?  We want to know, we need to know.

Dodd could cost CBS millions

If Tubby Smith, or Minnesota, would decide to sue CBS for libel and slander, after the Dennis Dodd story, on the eve of the NCAA tournament game, I think they could make a mint.  Maybe Auburn could even get-in on it?

Any settlement will be news.  This is pretty quick to be talking about the cost to ND but it is on the minds of people.  It is not just the anti-ND or anti-Catholic people who are curious and want the school/insurance company to pay.  My opinion is that the Sullivan family with a daughter still at ND are not as likely to seek as settlement from their church school.
I would also guess ND has the class to offer the family a sizeable amount of money to honor the grieving family as well as setting up a scholarship in Declan Sullivan's name for future team videotapers and and helpers.
It is too bad young Mr. Sullivan did not say something or refuse to go up in the tower.  It appears he put too much trust in the older adults to make the decsion about the safety of the tower.  It is what people his age often do until they learn to trust their own gut feelings.
Coach Kelly, the AD who was present, players, and managers...any of them could have seen the danger and spoken up but evidently the only person who said anything was the victim himself, who was too young, naive, inexperienced to take charge of his own fate.

Declan Sullivan death could cost ND millions

I think this is a very sad thing to be discussing. I'm certain very few here may know the family and I think we should focus on something more positive. I think this is a very tastless issue to have even began discussing Dodd. Not one of your better decisions. Very Sad this is all you can talk about today...
