Declan Sullivan death could cost ND millions

Forbes.com is reporting that Declan Sullivan's death could cost Notre Dame at least $30 million.

The site researched Indiana liability law as well as typical wrongful death cases. That's assuming Sullivan's family sues the school.

It's not a question of ND being able to afford the cost and result of such a case. Notre Dame historically is interested in protecting its "brand". A protracted legal case doesn't do anyone any good. If that means settling with the Sullivans then that might be what it takes.

Wow!  Gipper10 is proof-positive that our wonderful "No child left behind" program is an overwhelming failure.  The program pushes children through the system, whether they "get it" or not, and by graduation day, they are society's problem.

I realize that sometimes typing shortcuts are used for the sake of speed, but in this case Gipper, why don't you spend less time on the mesage boards posting rants like a Notre Dame loyalist and more time going to some form of English class to improve your deficient spelling and grammar.

As for the accident, it's just that...an accident.  That kid could have gotten off of that tower instead of Twittering how frightening it was.  The countrywide death of common sense is very sad.

It's a tragic accident.  If the family sues, any compassion I have for them flies right out the window.  Oh wait, that's the American way of getting rich.  Sue the crap out of someone else.  Here's a novel idea.   We have choices.  Go up in the air on the lift or make a judgement call for our own safety and say 'you know what, it's not safe. I'm not going up'   I at least have respect for Kelly for "manning" up and telling everyone that it was his call to be outside for practice.  It is sad that the kid lost his life, even sadder still that SEVERAL people (any of the coaches, the trainers, any of the managers, Sullivan) and avert this tragedy. I wish I could sit on the jury...I'd vote a big fat HELL NO!  It is high time that people be held accountable for failing to make smart decisions themselves.  Kelly screwed up, Notre Dame screwed up, but in the end, Sullivan didn't HAVE to get on that lift, if he felt his life was in danger, which it apparently was, he shouldn't have gotten on it.  Nobody forced him on there, nobody held a gun to his head, he is just as responsible as the rest.

It is highly embarrassing to see what horrible spelling and grammar you have. If you want people to take you seriously, you need to start spelling simple elementary school words correctly. For example dought is doubt. I have no idea how you graduated highschool. I feel sorry for you, because your teachers failed you. It boggles my mind to see how many mistakes were in a short paragraph like that. We are all ten percent dumber for reading that, and may God have mercy on your soul.

"Gipper" represents the same "above the law" and "above all else" attititude that characterizes ND the school and most all of its' fans...I listen to this "holier than thou" crap WAY too much living within 30 minutes of "Self Declared Mecca."  This is the school that lied to the city of South Bend about when it would start games when it entered into its last "blow us" phase with NBC (thus hurting all local businesses except curiously where ND bought up all the property and created Eddy Commons)....this is the school that has to have its own city title but the city of South Bend allows itself to be raped by them and provides all police, fire, and other "city services" (even though the Roman Catholic church is BY FAR the richest organization in the world)...this is the school that is too arrogant (and now too crappy of a program) to join a conference (which the NCAA if it had any balls should MAKE them, Army, and Navy HAVE to do)...this is the school that gets to go to a BCS bowl game at 6-5 with crappy scheduling when no one else gets to do the same "because they are Notre Dame"... so of course this would be where some misdirected "fan" would claim them less than liable...

Bottom line is the kid had free will, but the school and the football program (and Kelly as the head of the football program) had and have the responsibility to protect the students' well being.  ND will pay a LOT of money in this (we are talking multi-millions) and they should....

I pray for the day that ND is treated like EVERY OTHER college program and not with pussy kids' gloves it gets....makes me sick.

Declan Sullivan death could cost ND millions


The National Weather Service reported winds of 51 mph in South Bend this afternoon. On campus, students struggled to fight the gusts as they walked to class. On Tuesday, in the wake of a tornado warning, Notre Dame football coach Brian Kelly held the first indoor practice of his tenure, but despite similarly windy conditions today, the team resumed outdoor practice. Declan Sullivan sent this message to his Twitter account less than an hour before his tragic fall at 4:50 p.m., and it reads, "Holy f*** holy f*** this is terrifying."

Brian Kelly is the HEAD FOOTBALL COACH at Notre Dame and he is 100% responsible for any and all happens that deal with the program. Ultimately it was his call whether or not they practiced in those conditions. He did not take into consideration the well being of his staff which includes Declan Sullivan. The elements caused Declan Sullivan's death, but Brian Kelly and Notre Dame are at fault for allowing it to happen. Both Brian Kelly and Notre Dame should be sued for wrongful death so that in the future, a coach, a player, an administrator with THINK before they put anyone in danger.

I don't understand why ND would be liable and for so much other than the legal lotto we have in the US. No doubt it's a tragedy what happened to this young man and his family. BUT the question is why if the conditions looked that dangerous as he tweeted why did he forge onward and get onto the tower? Poor decision. Lesson to the younger generation: if you're ever in a situation where you feel uncomfortable get out of that situation.

I doubt that $30 million will come completely out-of-pocket for ND. I would assum all large organizations, like universities, have liability insurance for these kinds of things.
