49ers activate LB Aldon Smith from reserve/non-football injury list

Aldon Smith's month-long stay on the reserve-non-football injury list is officially over. The 49ers activated Smith from the NFI-list on Thursday making him eligible to play in San Francisco's next game on Nov. 10. The 49ers are on a bye this week.

Smith was placed on the NFI-list on Sept. 23 following a DUI arrest three days earlier. Shortly after being placed on the NFI-list, Smith took a personal leave of absence and checked-in to a rehab facility for counseling and inpatient rehabilitation.

"I am taking a leave of absence to address my health," Smith said at the time. "I am sorry that I have affected my team, my family and the organization. I will do everything in my power to handle this situation the best way possible. I appreciate the support of the 49ers and our fans."

The 24-year-old linebacker was back in the Bay Area on Tuesday to turn himself in on felony weapons charges. Surrendering by the end of October was part of an agreement Smith made with the Santa Clara District Attorney after he was charged with possessing illegal assault weapons on Oct. 9.

Shortly after turning himself in on Tuesday, Smith was released on $75,000 bail. After making bail, Smith spent Wednesday at the 49ers team facilities in Santa Clara.

"Aldon was in the building," coach Jim Harbaugh said on Wednesday. "It was great to see the reaction of others who saw him and Aldon's reaction of being back here with some of the guys. He looks great, and we're having a great day."

Just because Smith's back on the team doesn't mean his legal woes are behind him. Smith's scheduled to appear in court to face the felony weapons charges on Nov. 12. On Nov. 19 he'll be back in court to face misdemeanor DUI and drug charges.
