Aaron Hernandez's attorney asks judge to throw out evidence

Attorneys for Aaron Hernandez asked a judge to throw out evidence in the Odin Lloyd murder case and said that the murder charge against Hernandez should be dropped because the prosecution hasn't established a motive.

Hernandez's lawyers said the surveillance video taken from Hernandez's home should be excluded from trial, because the warrant used by police to search his home did not have probable cause.

The video, a screen-shot of which you can see below, appeared to show a gun in Hernandez's hand and was taken, police said, about 15 minutes after Lloyd's killing.

According to attorney James Sultan, via the Boston Globe, the prosecution's case to the grand jury was "woefully lacking."

The prosecutors, though, countered by saying that the investigation was "all but conclusive" and that the search warrant was appropriate. They also said the evidence against Hernandez was "powerful."

The judge did not immediately rule. The trial is tentatively scheduled to begin Oct. 6.

Hernandez also was arraigned on Monday for attacking a handcuffed inmate and threatening to kill a jail guard. He pleaded not guilty to both charges.

About a month ago, Hernandez was indicted in a double murder drive-by shooting that occurred in 2012. He's pleaded not guilty to those charges.
