Aldon Smith sentenced to 12 days in jail, but might not serve time

49ers linebacker Aldon Smith was sentenced Friday to 12 days in jail on gun charges, but it doesn't appear that Smith actually will serve any time.

Smith had pleaded no contest to three felony assault weapons charges and a misdemeanor DUI charge, but the judge downgraded those felonies to misdemeanors. The judge also said he could participate in a work-release program rather than go to jail.

That means Smith will work on a crew every Monday for 11 weeks beginning July 28. He also is on probation for three years-- during that time, he can't own a gun or ammunition -- and he must serve 235 hours of community service and pay a $2,000 fine.

Before he was sentenced, Smith, who could have faced up to 52 months in jail, apologized and told the judge, "I will abide by any order you give."

Before the judge ruled, though, this was an interesting twist.

The prosecutor, though, also said that the gang members were not invited to Smith's gathering. Either way, the news seemingly was pretty good for the 49ers.
