Dayton's Dyshawn Pierre suspended due to sexual assault allegation

Dayton senior Dyshawn Pierre, a double-digit scorer last season, is not enrolled in classes this semester because of a suspension caused by another student accusing him of sexual assault in May, and whether he'll ever return to the Atlantic 10 institution remains unclear -- though Pierre could theoretically play for the Flyers again in late December.
The investigation into the allegation was concluded in June, according to the Dayton Daily News. It was then turned over to the Montgomery County Prosecutor's Office. And Montgomery County Prosecutor's Office spokesman Greg Flanagan told the paper on Wednesday that his office declined to press charges "due to insufficient evidence."
Pierre has denied any wrongdoing.
Regardless, a source told CBS Sports he was suspended for the semester.
Pierre's accuser told an investigating officer that, after a night of drinking at a local bar, she returned to Pierre's campus residence, where he pressured and sexually assaulted her while "she pushed at the suspect and told him to stop."
Pierre's version of the night was different.
"At no time did she by words or actions ever indicate that she was an an unwilling participant," he wrote in a statement, according to the Dayton Daily News. "I never held her down so it was impossible for her to get away, or held her down in any way. I never told her to or demanded that she do anything. Everything we did was totally consensual."
Pierre averaged 12.7 points and 8.1 rebounds last season.
The 6-foot-6 forward has scored 1,145 points through three years of college.
