Report: Cowboys DT Josh Brent in jail after second failed drug test

Dallas Cowboys defensive tackle Josh Brent is behind bars after failing his second drug test in less than a month, according to KXAS-TV, an NBC-affiliate in Dallas

Brent had been free on a $100,000 bond while he awaited trial on intoxication manslaughter charges stemming from a Dec. 8 car crash that killed teammate Jerry Brown. On the night of the crash, Brent was driving his vehicle with a blood-alcohol level that was more than twice the legal limit.

Dallas prosecutors have been requesting that Brent be put behind bars since May, when he set off an alcohol-monitoring device and failed to download data from it as required. At a hearing on May 24, a judge decided not to jail Brent but did order the 25-year-old to submit to breath samples to monitor his alcohol intake. 

At that same hearing, Brent was tested for marijuana, a test that he reportedly failed. After the test, the prosecution once again asked that Brent be put in jail, but the Cowboys defensive tackle remained free. 

Brent was then tested for marijuana again on June 19, a test that came back positive on Tuesday, according to KXAS. The second failed test led to Brent being put behind bars on Thursday. 

No new bond has been set for Brent, which means he could be in jail until his next court date on July 19. 

Brent faces up to 20 years in prison if convicted on the intoxication manslaughter charge.
