Report: Decision on Josh Gordon appeal coming in 1-3 weeks
Josh Gordon could be waiting up to three weeks before he finds out if he's suspended.
The appeal hearing for Browns wide receiver Josh Gordon wrapped up on Monday after two days of proceedings, but a decision on Gordon's possible year-long suspension isn't expected just yet. According to Cleveland.com, it will be another one to three weeks before Gordon learns his fate.
Gordon's appeal started on Friday in New York City and went on for 10 hours before everyone decided to call it a day. The appeal then continued on Monday for three more hours. Gordon was in attendance for Friday's session, but was in Cleveland on Monday and participated in the hearing by phone.
Under the collective bargaining agreement, hearing officer Harold Henderson is either supposed to suspend Gordon for the entire season or not suspend him at all, there's no middle ground. However, according to ProFootballTalk, Gordon and the NFL can still come to a compromise on a suspension where Gordon would miss less than 16 games, but more than zero. The chance to compromise is off the table once Henderson makes his decision.
During the appeal, Gordon argued that his failed drug test was a result of second-hand smoke. Gordon's failed test came out at 16 nanograms per milliliter, just one nanogram above the NFL's threshold of 15 nanograms per milliliter.
Gordon's drug test actually consisted of two samples: The 'A' sample was the one that failed, while a second 'B' sample passed the NFL's drug threshold, measuring at 13.63 ng/ml.
That discrepancy is also believed to have played apart in Gordon's argument because both the 'A' sample and 'B' sample came from the same specimen, meaning they should have tested out to almost the same number.
The Browns wide receiver has passed at least 70 drug tests since being entered into Stage III of the NFL's drug program last year. Gordon was suspended for the first two games of 2013 after allegedly using cough syrup that contained codeine, a banned substance.
Gordon was in camp on Monday and is allowed to continue to practice with the until a decision has been rendered.
