1. Introduction 2021 CBSSports.com Conference Bracket Challenge Welcome to the 2021 Conference Bracket Challenge (the "Sweepstakes"), which is a competition based on results of each of the following 2021 Men's College Basketball Conference Tournaments: Pac-12 Conference ("PAC 12"), Atlantic Coast Conference ("ACC"), Big 12 Conference ("BIG 12"), Big Ten Conference ("BIG 10"), Big East Conference ("BIG EAST") and Southeastern Conference ("SEC") (each, a "Conference Tournament") (collectively, the "Conference Tournament(s)"). Participants will attempt to select the winners of one (1) or all six (6) of the Conference Tournament(s). Participants will earn points by correctly predicting the winning teams in the games of the applicable Conference Tournament(s). The exact number of points awarded in this Sweepstakes is set forth in the "Making Picks" section of these Official Rules. The Prize, as defined below, will be awarded to the randomly selected participant who is among the top ten percent (10%) of point scorers in one or more Conference Tournament(s) as described below. Participants will attempt to predict the winning team of the games played in the applicable Conference Tournament(s) (as defined above). The Sweepstakes is divided into six (6) individual Conference Tournaments. All six (6) Conference Tournaments make up the Sweepstakes. Participants can play in one or more Conference Tournaments. Participation in all Conference Tournaments is not required but is recommended to maximize your scoring opportunity. Eligible Participants whose score places them among the top ten percent (10%) of point scorers in each Conference Tournament entered, per the scoring rules set forth in the "Making Picks" section, will be entered into the random prize drawing to win the Prize as described in the "Prize" section. Early sign-up will begin on February 23, 2021. The Sweepstakes will begin on Tuesday, March 9, 2021 and end on March 14, 2021 after the conclusion of the last Conference Tournament Championship (the "Sweepstakes Period"). For purposes of clarity, the deadlines for submitting your picks for each Conference is the scheduled start time of the first game of each applicable Conference Tournament. No Cost If you are a wireless service subscriber and have a smart phone, tablet and/or wireless device that allows you to access this Sweepstakes, you may enter the Sweepstakes via any of those devices during the Sweepstakes Period. If you decide to participate in the Sweepstakes via any such wireless devices, you may be charged data rates in accordance with the Terms and Conditions of the Service Agreement with your wireless carrier. IMPORTANT NOTICE: THIS CHALLENGE IS SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS AS DETAILED BELOW. The Administrator CBS Interactive Inc. If you are not a Registered User, you may become a Registered User and obtain an ID and a Password by completing the CBS Sports Service registration form, accessible at www.cbssports.com ("CBS Sports Service") or by going here on the CBS Sports Service. There is no fee or charge to become a Registered User. Employees of CBSI., the National Collegiate Athletic Association ("NCAA"), Conference Tournament Employees, CBS Broadcasting Inc., The Hertz Corporation, and ViacomCBS, (collectively, the "Sweepstakes Entities") and each of their parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies (collectively, the "Released Parties") and members of the immediate family or household of each are not eligible to win. Immediate family member is defined as a parent, sibling or any person residing in the same household as an employee of the Sweepstakes Entities. Void where prohibited by law. Professional and/or college basketball players, team owners, management and personnel; professional sports agents; referees; and league employees who play/work in the United States, are not eligible to play in this Sweepstakes as well as, employees of a sports betting operator and/or an operator of a fantasy sports website offering paid contests. 2. Playing Signing Up Early Sign-up: Registered Users can sign up early for the Sweepstakes starting on February 23, 2021. Participants can begin making selections for certain of the Conference Tournaments on or about March 7, 2021, by visiting the CBS Sports Service; Participant will be able to modify their entry up to the scheduled start time of the first game of each applicable Conference Tournament. Participants will be asked to go to the bracket page on the CBS Sports Service (accessible at https://picks.cbssports.com/college-basketball/conference-tournament/bracket) and follow the onscreen instructions (the "Onscreen Instructions") to fill in the entry bracket in order to get an entry into the Sweepstakes. Onscreen Instructions are hereby incorporated by this reference to these Official Rules. Limit one (1) entry per registered user, per Conference Tournament for a maximum of six (6) entries for the entire Sweepstakes. Due to any unforeseen circumstances, including, without limitation, any game(s) cancellation or delay(s), the absence of game(s) statistics, a pandemic (e.g. Covid-19) and/or any other circumstances beyond CBSi's control, CBSI may in its sole discretion make material changes to this Challenge, including, without limitation, canceling the Challenge and/or concluding the Challenge early. If such changes are necessary, they will be noted in these Official Rules. Selection Deadline Brackets for each Conference Tournament will be posted as the schedules are determined and published for each conference between March 6-8 on the Sweepstakes site. Entries may be completed and submitted starting around March 7, 2021. Participants can change their picks as many times as they want, however, deadlines for submitting picks for each Conference Tournament is the scheduled start of the first game of each applicable Conference Tournament. Making Picks Between March 6-10, 2021, depending on when each Conference Tournament match-ups become available, you will have access to the online brackets page on the CBS Sports Service, that shall list the different Conference Tournaments and their match-up games. The Administrator, at its sole discretion, will make all available each conference bracket on the CBSI Site once the regular season has ended and seeds are determined. In order to participate in the Challenge, participants must: (i) go to the CBSI Site; (ii) pick the team(s) they predict will win their opening round matchup of each tournament game and subsequent matchups created based on your previous selections all the way through the championship game; (iii) login to their CBSSports.com account (or create an account if you do not have one); (iv) create an entry name; PLEASE NOTE: all picks are automatically saved; every time you make a change to your picks the changes will be automatically saved and will override your previous picks. Participants must enter their projected winners for all games in a given Conference Tournament. Scoring is as follows: Participants will receive one (1) point for each correct pick in the Quarterfinals and earlier rounds. Participants will receive two (2) points for each correct pick in the Semifinals. Participants will receive four (4) points for each correct pick in the Finals. 3. Odds/Drawing/Winner Notification Odds of winning the Prize depend on the number of eligible Participants and the outcome of each Conference Tournament, as described above. The random Prize drawing will be conducted by Administrator, and the Prize winner (the "Winner") will be chosen from among all eligible entries received in accordance with the terms herein. Each eligible participant whose score ranks within the top 10% of scorers in a particular Conference Tournament of the Sweepstakes will receive one (1) entry into the Prize drawing. Participants may accrue a maximum of six (6) entries per person (one per Conference Tournament of the Sweepstakes). The random Prize drawing will be conducted on or around March 22, 2021. Winner Notification will include instructions regarding how to claim the Prize. The potential Winner will be required to agree to the CBSSports.com Wallet Terms of Use and complete and submit the CBSI Affidavit of Eligibility and Publicity release (the "Affidavit") except where prohibited by law. For additional information on the CBSI Wallet, please visit the Wallet Terms of Use. Such Affidavit must be signed and returned within 15 days of issuance. Failure to return such documents within the specified time period, non-compliance with these Official Rules, the return of any prize or prize notification, or if any potential Winner declines a Prize for any reason, could render such person as disqualified with an alternate Winner selected via random drawing, in accordance with these Official Rules (as applicable). If the potential Winner cannot be reached after a reasonable effort has been made for five (5) days from the first notification attempt, such person may be disqualified, with an alternate Winner selected in accordance with these Official Rules. Only one attempt for a new alternate will be conducted. If attempt fails, Prize will not be awarded. Submitting such Affidavit will require potential Winner to provide their social security number and a copy of their valid (non-expired) driver's license or other government-issued identification (Passports are not accepted) that includes the Winner's address. Grand Prize The Sweepstakes will award one grand prize (the "Prize") which consists of Ten Thousand Dollars (US$10,000.00). Prize is to be awarded in the form of a check via the CBSSports.com Wallet. Prize Restrictions No assignment, transfer, or substitution of the Prize or any portion of the Prize is permitted, except Sponsor reserves the right to substitute the Prize or any of its components with a prize of comparable or greater value, should the Prize or any of its components become unavailable, or for any other reason the Prize needs to be exchanged. All Prize details are at the sole discretion of the Administrator. Participants may enter only once per Conference Tournament. Attempts to enter multiple times for any single Conference Tournament will result in disqualification from that Conference Tournament. Participants may not play with multiple email addresses, nor may participants use any other device or artifice to play multiple times or as multiple participants. 4. Legal Disclaimers All participants agree to abide by the terms of these Official Rules, the Legal Disclaimers below, and by the decisions of CBSI, which are final and binding on all matters pertaining to the Sweepstakes. General Conditions By entering, each entrant accepts and agrees to be bound by these rules and by the decisions of CBSI, which shall be final and binding in all respects. Furthermore, each entrant also acknowledges and agrees to the CBS Interactive Inc. Terms of Use and Privacy Policy, incorporated herein by reference. All federal, state, local and other tax obligations arising from this Sweepstakes, including, without limitation, winning the Prize, will be the sole responsibility of the Winner. Except where prohibited by law, the Winner's acceptance of the Prize constitutes permission for the Released Parties to use Winner's name, photograph, likeness, statements, biographical information, voice, and address (city and state) worldwide and in all forms of media now known or later developed, in perpetuity, without further compensation. All federal, state, and local laws and regulations apply. The Released Parties are not responsible for lost, late or misdirected online entries or transactions, incorrect, inaccurate or incomplete entry information, whether caused by a participant, equipment, or technical malfunction or for any human error, technical error or malfunctions. CBSI reserves the right to halt or modify the Sweepstakes at any time during the Sweepstakes period, if events beyond their control compromise the Sweepstakes' fairness or integrity. In the event that a scheduled game is canceled or preempted for any reason, no points will be awarded for the affected NCAA® teams. If a team is forced to forfeit a matchup resulting in another team advancing, points may still be rewarded to the winning team. The Released Parties are not responsible for typographical or other human or technical errors in the offer or administration of this Sweepstakes, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the Winner or the distribution of the Prize. CBSI, in its sole discretion, may disqualify any entrant from participating in the Sweepstakes, refuse to award points or the Prize, and/or require the return of the Prize, if entrant engages in any conduct CBSI deems to be improper, unfair or otherwise adverse to the operation of the Sweepstakes or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during Sweepstakes registration or Prize claim, violating any term or condition stated herein, accumulating points or a Prize through methods such as automated computer scripts or other programming techniques, allowing others to use the entrant's personal information for the purpose of accumulating points or a Prize, tampering with CBSI's administration of this promotion, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on this website. Participant further acknowledges that the forfeiture of the Prize and/or return of the Prize shall in no way prevent CBSI from pursuing other avenues of recourse, such as criminal or civil proceedings in connection with such conduct. Internet If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of CBSI which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, CBSI reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. In such event, CBSI further reserves the right to award the Prize to the eligible participants selected randomly from among the participant whose score resides in the top 10% of all scores in one or more of the applicable Conference Tournaments of the Sweepstakes in accordance with these Official Rules. Any controversy or claim arising out of or relating to these Official Rules and/or the Challenge shall be settled by binding arbitration in accordance with the commercial arbitration rules of JAMS in accordance with the JAMS Comprehensive Arbitration Rules and Procedures, as modified by the JAMS Consumer Arbitration Minimum Standards. Class arbitrations and class actions are not permitted under any circumstances. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California, in the City of San Francisco. Governing Law and Jurisdiction THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration, as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the participants and/or parties irrevocably submit and consent to the exclusive jurisdiction and venue of the State of California state and federal courts located in the City of San Francisco.
