SETTINGS & TERMS OF USE

1. Introduction
2016 CBSSports.com DraftMaster
Service
CBS
Interactive Inc. ("CBSI")
provides the 2016 DraftMaster Service (the "DraftMaster") to you ("you" or "your"),
subject to the following 2016 CBSSports.com Draft Master Terms of Use ("DMTOU") which may be updated by
CBSI without notice to you. It is important for you to refer to this DMTOU from
time to time to make sure that you are aware of any additions, revisions, or
modifications that we may have made to this DMTOU. You can review the most
current version of this DMTOU at any time at: http://www.cbssports.com/info/about/tos/dm.
Your use of the 2016 DraftMaster Service constitutes your acceptance of this
DMTOU.
DraftMaster is a mobile-only
game. If you are a wireless service subscriber and have a smart phone, tablet
or wireless device that allows you to access DraftMaster, you may enter
DraftMaster on any of those devices during the NFL regular season (as defined
below). Participating via a wireless device, may result in you being charged
data rates according to the Terms and Conditions of your Service Agreement with
your wireless carrier. Each wireless carrier's rate plan may vary, and
participants should contact their wireless carrier for information on rate
plans and charges relating to your participation in this game.
DraftMaster is a free fantasy football
service that offers users the ability to create and/or join private fantasy
leagues of up to 8 users. Each
private league has a commissioner, standard settings and lasts for the duration
of the NFL season. Most standard settings within the DraftMaster cannot be
changed.
Users can be invited to join leagues by
a commissioner or other league member(s), depending on league rules. Once in a
league, users draft their teams weekly and compete amongst friends to win the
league title.
The Commissioner
The commissioner of a fantasy football league is
responsible for coordinating and managing the league. CBSI will be responsible
for resolving any disputes that arise regarding alleged rules violations or
anything else in connection with DraftMaster.
2. League Setup
App Download
DraftMaster is a mobile-only
game. All participants will need to download the DraftMaster mobile app via the
Apple App Store or Google Play Store in order to sign up and play.
Signing Up
DraftMaster is FREE
to play. All participants will need to agree to comply with game rules
prior to signing up. If you are not a Registered User (as defined below), you'll be prompted
to register free with CBSI prior to signing up for DraftMaster. Data
charges may apply depending on your mobile service plan.
When you first sign-in, you will be prompted to create a "GamerTag." Your
GamerTag is your team name that will display in all of your DraftMaster fantasy
leagues. Your GamerTag will be
your primary identifier throughout the product. Your GamerTag must be unique.
In
addition to creating a GamerTag, you will be prompted to allow DraftMaster to
send alerts to your mobile device via push notifications. It is recommended to enable push
notifications to ensure you are aware of significant events as they occur in
your league(s).
Eligibility
DraftMaster is open to persons who are: (a) Registered
Users; (b) legal residents of the United States, Puerto Rico or Canada
(excluding Quebec) (for purposes of clarity all other US territories and
possessions are expressly excluded); (c) at least thirteen (13) years
old, at the date of registration in the Challenge to DraftMaster. Void where
prohibited by law.
For purposes of these Terms of Use, "Registered User" means a person
who has successfully completed the registration form and has obtained a User
Identification ("ID") and
associated password ("Password")
on one of the CBSI network of websites which currently include the following:
CBSSports.com and SportsLine.com.
If you are not a Registered User you may become a
Registered User and obtain an ID and a Password by completing the CBSSports.com
registration form by going here on CBSSports.com. There is no fee
or charge to you to become a Registered User.
Name League
From the home screen of the DraftMaster
app, you must tap Create New League
to initiate the league creation process. The only information required at the
time of creation is the name of the league. You have up to 26 characters at your disposal when naming
your league; the name does not need to be unique. You will not be able to
proceed until a league name has been set. Tap Create League, to create your league.
Invite Settings
For all DraftMaster leagues, the
commissioner has the ability to configure invite settings during initial league
setup. The league invite setting
will either be open or closed.
Open invites, which is the default
setting, means all the league members having the ability to invite users to
join the league. Closed invites means only the commissioner may invite users to
a league.
Commissioners have the ability to
remove any league member regardless of selected invite settings, however this
must be done prior to start of league season.
Start of
Season
The commissioner will have the ability
to officially start the league's season once the league has at least 4
confirmed users. Commissioner's can start the league season by starting the
first draft.
3. First League Draft
Extended Draft Overview
Each fantasy football team will acquire its players
through a draft. DraftMaster leverages
an extended online draft format that takes place over multiple days, allowing
users to make their draft picks on their own time.

The commissioner will manually trigger
the start of the league's first draft. Once the
league draft has begun, you will receive an alert via push notification. Tapping on the alert will launch the
app and redirect users to the draft room.

Order
The draft
order will appear on the left side of the draft room with a badge highlighting
the current pick and the direction of the draft order. The first
league draft will have a randomized draft order in snake draft format.
Managing
Your Queue
You can create your own
ranked list of draft prospects by adding players to the queue. In the event you enable "auto-pick," the system will
automatically select your top ranked player in the queue.
"On-The-Clock" Alert
When it's your pick, you
will receive an alert via push notification. Tapping on the alert will launch the app and redirect you to
the draft room.
Time
Bank & Pick Clock
League members are allocated a set
amount of time to make all of their picks; this is known as the time bank. The
time bank is drained while the user is on the clock, during draft hours.
The pick clock displays the max amount
of time the user has to make his or her pick. To ensure users always have enough time to make their pick,
the system will reserve 10 minutes in the user's time bank for each of their
remaining picks.
Making
the Pick
There are two ways you
can manually select a player: (i) swiping the player cell and tapping "DRAFT," or (ii) tapping "DRAFT" from the player's profile
page.

Picks After Hours
The draft clock will run
from 11a.m. to 9p.m. Eastern Time ("ET")
every Wednesday through Saturday of the league season. Once the draft has
started, users can make untimed picks outside of draft hours without using time
from their time banks.
Going on
"Auto"
Turning on "AUTO" or allowing your pick time
to expire will result in an auto-pick selection for your team. The system will automatically pick the
best player available, with the players in your queue taking priority.
Draft
Deadline
For drafts starting prior to Saturday (8:00
p.m. ET) of the period, the automated time bank allocations ensure they will
complete by 12:55 p.m. ET on the next day.
All drafts starting after Saturday of
the period, will have time banks configured for a Sunday afternoon deadline in
the next period.
Draft
Results
Once your league's draft is complete, you'll have the
ability to view the round-by-round results via the draft room's Summary
tab.

DraftMaster uses a
standard half point per reception scoring system across all leagues. Customized
scoring settings are not supported at this time.

Ranked Scoring
System
In DraftMaster's ranked
system, league standings are determined by the cumulative fantasy points
accrued over the course of the league season. There are no head-to-head
matchups or records.

ROSTER MANAGEMENT
Weekly
Lineup
Each team will have a weekly lineup
that includes 10 players. Each team will be made up of the following positions:
QB, RB, WR, TE.
Optimized
Lineups
Unlike traditional
fantasy football games, there is no setting of starters outside of the fantasy
draft. All lineups are
automatically optimized in near real-time, only counting the scores of your
team's top performers at each position.
Your weekly score will be
made up of points scored by your top: QB, 2 RB, 2 WR, TE. Aside from drafting your team and
setting your keepers, there's no roster management required.

Setting
Keepers
Each week, users can
select up to 3 players to keep from their current roster for the upcoming
period. For each player kept,
users will have to forfeit a draft pick, starting with the user's first round
pick.
Keepers can be set as
soon as the league's draft is complete.
To launch the keeper tap "SET
KEEPERS" button from the league home. Once keepers have been selected, tapping "CONFIRM KEEPERS" will save the keeper
selections for the period.
Following a confirmation
message, users will be redirected to the League Home screen where the selected
keepers for the period will be displayed.
6. Weekly Drafts (After First
Draft)
Weekly Draft
Overview
The weekly draft offers a similar
experience to the league's first draft, with a few exceptions, which are listed
below.
Draft
Start
All drafts after the league's first
draft will begin Wednesday at noon ET of the given period. The draft clock will run noon to 11:00
p.m. ET Wednesday through Saturday, and Noon to 12:55p.m. ET on Sunday.
Picks can be made at any time between
the start of the draft and 12:55p.m. ET on Sunday, but the draft clock and time
bank will only be enforced during official draft hours. This setting is to prevent the need to
make picks at odd hours.
Draft
Order
The draft
order will appear again on the left side of the draft room, with a badge
highlighting the current pick and the direction of the draft order. However, the
draft order for all weekly drafts is the reverse order of league standings. The
draft order for weekly drafts will not snake.
Users that have kept
players from the previous week will forfeit at least one of their first 3
picks, depending on the number of players kept. The pick(s) to be forfeited are determined by the following:

selected: 1st round pick forfeited

keepers selected: 1st and 2nd round picks forfeited

3
keepers: 1st, 2nd, and 3rd round picks forfeited
Draft
Deadline
The automated time bank allocations
ensure that all re-drafts are complete by 12:55 p.m. ET on Sunday of the
current period.
7. Definitions.
"CBSSports.com Web Site"
means the CBSI web site located at the domain "cbssports.com" or
other domain as determined in the sole and exclusive discretion of CBSI.
"CBS Sports Content" shall
mean any and all proprietary images, technology, applications, artwork, copy, information,
trademarks, service marks, data, or knowledge or other materials made available
to you as part of the 2016 DraftMaster Service.
8. Term Termination and Survival. This DMTOU is effective as of the
Effective Date, above, and shall remain in full force and effect for the period
the 2016 DraftMaster Service is available on the CBSSports.com Web Site, unless
earlier terminated as provided herein (the "Term"). Sections12 through 15 of this DMTOU and other
provisions which are set to survive the Term herein shall survive the
termination of this DMTOU.
9. The 2016 DraftMaster Service. Your registration for the 2016
DraftMaster Service gives you access to the features of the 2016 DraftMaster
Service from the time you register through the remainder of the Term.
No Internet Connection Equipment
Provided. CBSI
shall not be obligated to, and you acknowledge that CBSI will not, provide any
bandwidth, modem, computer, or any other equipment, system or connectivity for
you to connect to the Internet. You shall be solely responsible for all modems,
mobile devices, operating systems connection devices and bandwidth necessary
for connecting to the Internet through which you can access the 2016
DraftMaster Service and the CBS Sports Content.
Revision of the 2016 DraftMaster
Service. CBSI may
modify, suspend or discontinue any aspect of DraftMaster at any time,
including, without limitation, the availability of any CBS Sports Content. CBSI
may also impose limits on certain features and services or restrict your access
to parts or all of the 2016 DraftMaster Service and/or the CBS Sports Content
without notice or liability of any kind.
No Resale of the 2016 DraftMaster
Service. You
agree that this DMTOU is personal to you and that you may not resell, lease,
license, assign, redistribute or otherwise transfer any portion of the 2016
DraftMaster Service, including, without limitation, the CBS Sports Content.
No Accuracy of CBS Sports Content. The CBS Sports Content contains
information, advice, text and materials that are provided for your convenience
and enjoyment. Third parties provide some of the CBS Sports Content. You should
be aware that the CBS Sports Content might contain errors, omissions,
inaccuracies, outdated information, and inadequacies and that the CBS Sports
Content may be subject to terms and conditions which may be found in the
documents and policies of third parties. We make no representations or
warranties as to the completeness, accuracy, adequacy, currency or reliability
of any CBS Sports Content and will not be liable for any lack of the foregoing.
No Warranty of Lawfulness of the 2016
DraftMaster Service.
CBSI does not represent or warrant that every action you take with regard to
your account and related activities in connection with the 2016 DraftMaster
Service, including, without limitation, the CBS Sports Content, will be lawful
in any particular jurisdiction. It is incumbent upon you to know the laws that
pertain to you in your jurisdiction and act lawfully at all times when using
the 2016 DraftMaster Service, including, without limitation, the CBS Sports
Content.
Entertainment Purposes Only. The 2016 DraftMaster Service is for
entertainment purposes only and may not be used in connection with any form of
gambling or wagering.
Collection of Personal Information. All personally identifiable
information disclosed by Registered Users in connection with the 2016
DraftMaster Service is subject to the CBS Interactive Inc. Privacy Policy,
incorporated herein by reference.
Statistics Corrections. Following the completion of each
week's games, all statistics and point totals are verified, and corrections are
made where necessary. However, all statistics and point totals for the week are
considered FINAL as of midnight on Tuesdays of the applicable Weekly Scoring
period. If a statistic correction is announced for the previous weekend's games
on Wednesday or later, it will not be included in our statistics and your
official 2016 DraftMaster Service (Fantasy) scoring will be based on the
original statistics.
Suspension and/or Termination of Your
2016 DraftMaster Service Account.
CBSI expressly reserves the right to immediately modify, suspend or terminate
your 2016 DraftMaster Service account without refund and refuse current or
future use of the 2016 DraftMaster Service, if CBSI, in its sole and exclusive
discretion believes that you have acted inconsistently with the spirit or
letter of this DMTOU or the CBS Interactive Inc. Terms of Use, incorporated herein
by reference.
Suspension and/or Termination of the
2016 DraftMaster Service.
The 2016 DraftMaster Service and its related benefits are offered at the
discretion of CBSI and CBSI has the right to modify or discontinue, temporarily
or permanently, the 2016 DraftMaster Service, in whole or in part for any
reason, with or without notice to you. You agree that CBSI will not be liable
to you or to any third party for any modifications or discontinuance of the
2016 DraftMaster Service.
10. License and Proprietary Rights.
2016 DraftMaster Service License. During the Term, CBSI hereby grants to
you, and you hereby accept, a personal, non-transferable, non-commercial,
non-exclusive, limited, revocable license, to view and use the 2016 DraftMaster
Service, including the CBS Sports Content (where applicable, in executable,
object code form only). Nothing herein shall be interpreted to mean, and CBSI
does not grant you any right or license in any CBSI materials or other
proprietary images, trademarks, artwork, copy, information, data, knowledge,
computer software or any other material or information of any kind.
No Sublicense. Nothing herein shall be interpreted to
mean, and CBSI does not grant you, any right or license to enter into
sublicenses or redistribution agreements with respect to any portion of the 2016
DraftMaster Service, including, without limitation, the CBS Sports Content.
Copyright Notices. The 2016 DraftMaster Service,
including without limitation, the CBS Sports Content, are protected by
copyright pursuant to U.S. copyright laws, international conventions and other
copyright laws, and are owned or controlled by CBSI. You will abide by any and
all additional copyright notices, information, or restrictions contained in the
2016 DraftMaster Service, including, without limitation, the CBS Sports Content
or as CBSI otherwise may impose from time to time.
No Derivative Works. You represent, warrant and covenant
that you shall not reverse engineer, decompile, translate, modify, or develop
derivative works based on, the 2016 DraftMaster Service, including, without
limitation, the CBS Sports Content.
No Contest of Rights. You acknowledge and agree that both
during and after the Term, you shall not directly or indirectly contest or aid
in contesting the validity or ownership of the 2016 DraftMaster Service,
including without limitation, the CBS Sports Content or take any action
whatsoever in derogation of CBSI's rights therein or in breach of any terms and
conditions contained in this DMTOU.
Reservation of Rights. Any and all rights to use the 2016
DraftMaster Service, including, without limitation, any CBS Sports Content not
expressly granted to you under this DMTOU are hereby reserved for CBSI. Nothing
contained in this DMTOU shall affect, impair, or limit in any way CBSI's rights
to exploit fully the 2016 DraftMaster Service, including, without limitation,
any CBS Sports Content.
Proprietary Rights. You acknowledge and agree that CBSI
owns and shall retain all rights, title and interest in and to the 2016
DraftMaster Service, including, without limitation, the CBS Sports Content,
including, without limitation, all copies thereof and all rights to patents,
copyrights, trademarks, service marks, trade secrets and other intellectual
property rights inherent therein and appurtenant thereto.
No License to CBSI Trademarks. Nothing herein shall be interpreted to
mean, and CBSI does not grant you any right or license in any CBSI trademark,
tradename, service mark, insignia, slogan, name, emblem, logo, symbol, design
and/or other identifying characteristics owned by or associated with CBSI, its
parent, subsidiaries or affiliates, in any manner whatsoever.
11. Representations and Warranties.
You
represent, warrant and covenant that you will not upload, post, transmit,
distribute or otherwise publish through the 2016 DraftMaster Service any
materials which: (a) restrict or inhibit any other user from using and enjoying
the 2016 DraftMaster Service; (b) are unlawful, threatening, abusive, libelous,
defamatory, obscene, pornographic, profane, or indecent; (c) constitute or
encourage conduct that would constitute a criminal offense, give rise to civil
liability, or otherwise violate the law; (d) violate, plagiarize or infringe
the rights of any third party including, without limitation, copyright,
trademark, patent, rights of privacy or publicity, or any other right of any
third party; (e) contain a virus or other harmful or potentially harmful
component; (f) contain any unsolicited or unauthorized advertising, promotional
materials, spam, or any other kind of solicitation; and/or (g) constitute or
contain false or misleading indications of origin or statements of fact.
You
represent, warrant and covenant that you will comply with the CBS Interactive
Inc. Terms of Use (incorporated herein by reference) and this DMTOU in
connection with your use of the 2016 DraftMaster Service.
12. Disclaimer of Warranties.
THE
2016 DRAFTMASTER SERVICE, INCLUDING, WITHOUT LIMITATION, ALL CBSI CONTENT,
SOFTWARE, DOCUMENTS, FUNCTIONS, MATERIALS, GRAPHICS, AND INFORMATION MADE
AVAILABLE ON OR ACCESSED THROUGH THE CBSI SERVICE, ARE PROVIDED "AS IS" TO THE FULLEST EXTENT
PERMISSIBLE BY LAW, CBSI AND ITS SUBSIDIARIES AND AFFILIATES MAKE NO
REPRESENTATION OR WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER ABOUT: (A)
THE 2016 DRAFTMASTER SERVICE; (B) THE CBS SPORTS CONTENT MADE AVAILABLE TO YOU
THROUGH THE 2016 DRAFTMASTER SERVICE; (C) THE MATERIALS, INFORMATION AND
FUNCTIONS MADE ACCESSIBLE BY THE SOFTWARE USED ON OR ACCESSED THROUGH THE 2016
DRAFTMASTER SERVICE; (D) THE ABILITY OF THE 2016 DRAFTMASTER SERVICE TO WORK
WITH ANY PARTICULAR CLIENT APPLICATION; AND/OR (E) ANY BREACH OF SECURITY
ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE 2016
DRAFTMASTER SERVICE. CBSI DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE
2016 DRAFTMASTER SERVICE OR ANY MATERIALS OR CONTENT CONTAINED THEREIN WILL BE
UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE 2016
DRAFTMASTER SERVICE OR THE SERVERS THAT MAKE THE 2016 DRAFTMASTER SERVICE
AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
CBSI
DOES NOT WARRANT THAT YOUR ACTIVITIES OR USE OF THE 2016 DRAFTMASTER SERVICE IS
LAWFUL IN ANY PARTICULAR JURISDICTION AND, IN ANY EVENT, SPECIFICALLY DISCLAIMS
SUCH WARRANTIES. YOU UNDERSTAND THAT BY USING ANY OF THE FEATURES OF THE 2016
DRAFTMASTER SERVICE, INCLUDING, WITHOUT LIMITATION, THE CBS SPORTS CONTENT, YOU
ACT AT YOUR OWN RISK, AND YOU REPRESENT AND WARRANT THAT YOUR ACTIVITIES ARE
LAWFUL IN EVERY JURISDICTION WHERE YOU ACCESS OR USE THE 2016 DRAFTMASTER SERVICE,
INCLUDING, WITHOUT LIMITATION, THE CBS SPORTS CONTENT. FURTHER, CBSI AND ITS
SUBSIDIARIES AND AFFILIATES DISCLAIM ANY EXPRESS OR IMPLIED WARRANTIES
INCLUDING, WITHOUT LIMITATION, NONINFRINGEMENT, MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, AND TITLE.
CBSI
AND ITS SUBSIDIARIES AND AFFILIATES SHALL NOT BE LIABLE FOR THE USE OF THE 2016
DRAFTMASTER SERVICE INCLUDING, WITHOUT LIMITATION, THE CBS SPORTS CONTENT AND
ANY ERRORS CONTAINED THEREIN. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE
DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY
TO THE EXTENT SUCH JURISDICTION'S LAW IS APPLICABLE TO THIS DMTOU.
13. Limitation of Liability.
UNDER
NO CIRCUMSTANCES SHALL CBSI AND ITS SUBSIDIARIES AND AFFILIATES BE LIABLE FOR
ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES THAT ARE DIRECTLY OR INDIRECTLY
RELATED TO THE USE OF, OR THE INABILITY TO USE, OR THE PERFORMANCE OF, THE 2016
DRAFTMASTER SERVICE, EVEN IF FORESEEABLE OR CBSI HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR
OTHER TORTIOUS ACTION. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY
NOT APPLY TO YOU. IN NO EVENT SHALL CBSI'S TOTAL LIABILITY TO YOU FOR ALL
DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID, IF ANY, FOR
THE 2016 DRAFTMASTER SERVICE.
14. Indemnity.
You
agree to defend, indemnify and hold harmless CBSI and its subsidiaries and
affiliates with respect to any and all costs, claims, demands, investigations,
liabilities, losses, damages, judgments, settlements, costs and expenses,
including attorneys' fees arising out of or in connection with this DMTOU,
including, without limitation, your use of the 2016 DraftMaster Service,
including, without limitation, the CBS Sports Content. Notwithstanding the
foregoing, CBSI retains the exclusive right to settle, compromise and pay any
and all claims, demands, proceedings, suits, actions or causes of actions which
are brought against CBSI herein under the terms and provisions of this Section
14 and in no event shall you settle any such claim without CBSI's prior written
approval.
15. Arbitration.
You
waive all rights to trial in any action or proceeding instituted in connection
with these DMTOU and/or the 2016 DraftMaster Service. Any controversy or claim
arising out of or relating to these DMTOU and/or the 2016 DraftMaster Service
shall be settled by binding arbitration in accordance with the commercial
arbitration rules of the American Arbitration Association. Any such controversy
or claim shall be arbitrated on an individual basis, and shall not be
consolidated in any arbitration with any claim or controversy of any other
party. The arbitration shall be conducted in the State of California, in the
City of San Francisco, County of San Francisco.
16. Governing Law and Jurisdiction.
THIS
DMTOU AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN
ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA, WITHOUT REGARD TO ITS
CONFLICTS OF LAWS RULES.
For
any matters which are not subject to arbitration as set forth in these DMTOU
and/or in connection with the entering of any judgment on an arbitration award
in connection with these DMTOU and/or the 2016 DraftMaster Service, you
irrevocably submit and consent to the exclusive jurisdiction and venue of
California state and federal courts located in the City of San Francisco, and
State of California. The parties agree not to raise the defense of forum non conveniens.
17. Miscellaneous.
This
DMTOU contains the sole and entire agreement between the parties with respect
to the use of the 2016 DraftMaster Service and supersedes any and all other
prior written or oral agreements between them. Captions contained in this DMTOU
are inserted only as a matter of convenience or for reference and in no way
define, limit, extend, or describe the scope of this DMTOU or the intent of any
provision of this DMTOU. It is the intent of the Parties that neither this DMTOU,
nor any covenant in this DMTOU, shall be construed against either party
pursuant to the common law rule of construction against the drafter. It is the
intent of the parties that said rule not be applicable to this DMTOU. If any
provision of this DMTOU shall be held invalid or unenforceable by any court of
competent jurisdiction or as a result of future legislative action, such
holding or action shall be strictly construed and shall not affect the validity
or effect of any other provision of this DMTOU.
18. Report Violations.
If
you witness any user activity in the 2016 DraftMaster Service that violates
this DMTOU, please notify us of the activity via the feedback form located at
http://cbsi.force.com/CBSi/cbssports. CBSI cannot guarantee that any action
will be taken as a result of your e-mail, but we appreciate your help in making
the 2016 DraftMaster Service an enjoyable experience for everyone.

First Draft: The league's commissioner will manually start the draft. The commissioner will not have the ability to start the draft until league has at least 4 users.

Time Bank |
The time bank displays the total amount of time a user has to make all of their picks. Each league member will start with the same amount of time in their time bank. The time bank is drained while (when?) the user is on the clock, during draft hours.
Users cannot spend their entire time bank on a single pick. To ensure users always have enough time to make their pick, the system will reserve 10 minutes in the user's time bank for each of their remaining picks.

Week 1 (of League Season): Snake The draft order for the first draft of every league will be system generated in random order, in snake format.
Rest of League Season: Fixed All remaining drafts of the league season will have a fixed draft order, in ascending order starting with the 8th place team.
